This is a "Prohibited Mark" under subparagraph 9(1)(n)(i) of the Trademark Act, (number 0973316 approved May 13th 2015) being that "No person shall adopt in connection with a business, as a trade-mark or otherwise, any mark consisting of, or so nearly resembling as to be likely to be mistaken for any badge, crest, emblem or mark adopted or used by any of Her Majesty’s Forces as defined in the National Defence Act".[1][2] Trademark status is independent of copyright status.
